Waiver of Liability, Assumption of Risk, and Release
PLEASE READ CAREFULLY BEFORE SIGNING. This is a legal document that affects your legal rights.
In consideration of being permitted to enter and participate in activities at Blasted Arena (the "Facility"), including but not limited to jumping, playing, climbing, sliding, obstacle courses, interactive games, and all related recreational activities (collectively, the "Activities"), I agree as follows:
1. Assumption of Risk
I understand and acknowledge that the Activities involve inherent risks of serious injury, including but not limited to:
- Sprains, strains, fractures, dislocations, or other orthopedic injuries
- Head, neck, or spinal injuries
- Cuts, bruises, scrapes, or abrasions
- Collisions with other participants, equipment, or structures
- Falls from heights or onto padded/unpadded surfaces
- Exhaustion, dehydration, or other physical ailments
- In rare cases, permanent disability, paralysis, or death
These risks may be caused by my own actions (or those of my child), the actions of others, the condition of the Facility or equipment, or the negligence of Blasted Arena, its owners, employees, agents, or volunteers (collectively, the "Releasees"). I voluntarily assume all such risks, known and unknown, and agree that I (or my child) am physically fit and able to participate.
2. Release and Waiver of Liability
I, for myself, my child (if signing as parent/guardian), and on behalf of my heirs, executors, administrators, assigns, and next of kin, hereby release, waive, discharge, and covenant not to sue the Releasees from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury (including death), or property damage that may be sustained while participating in the Activities or while on the premises of the Facility, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
3. Indemnification
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, claim, or expense (including reasonable attorney’s fees) that they may incur as a result of my (or my child’s) participation in the Activities or presence at the Facility.
4. Medical Authorization
In the event of an injury or medical emergency, I authorize the Releasees to seek and consent to emergency medical treatment on my behalf (or my child’s behalf). I agree to be responsible for all medical costs incurred.
5. Rules and Safety
I agree to abide by all posted rules, safety instructions, and staff directions. Failure to follow rules may increase the risk of injury and may result in removal from the Facility without refund.
6. Photography / Media Release
I grant Blasted Arena permission to take and use photographs, video, or other media of me (or my child) for promotional purposes without compensation.
7. Governing Law and Severability
This Agreement shall be governed by the laws of the State of Maryland. If any part of this Agreement is held invalid, the remainder shall continue in full force and effect.
I have carefully read this entire Agreement, fully understand its terms, and sign it voluntarily and of my own free will. I am aware that by signing this document, I am giving up important legal rights, including the right to sue for negligence.
